Navigating IEPs and Out-of-School Suspensions: A Parent's Guide
My 4th grader with a new IEP has been suspended three times due to emotional regulation challenges. A manifestation determination and IEP meeting are coming up. Looking for advice and advocate support to ensure he gets the best school support.
📌 Understanding the Process: What to Expect
1️⃣ Manifestation Determination Review (MDR)
- This meeting determines whether your child's behavior was a direct result of their disability or the school's failure to implement the IEP.
- If yes, the school cannot continue suspensions and must adjust supports instead.
- If no, the school may proceed with discipline, but you can challenge the decision.
2️⃣ IEP Meeting Adjustments
- Review the Behavior Intervention Plan (BIP): Does it provide the right supports? If not, request updates.
- Consider Additional Accommodations: Sensory breaks, social-emotional learning, or a check-in/check-out system may help.
- Request a Functional Behavior Assessment (FBA) if one hasn’t been completed or needs updating.
🛠️ Advocating for the Best Support
✅ Bring an Advocate if Possible
- An advocate can help ensure fair decisions and hold the school accountable for proper IEP implementation.
- Contact local special education advocacy groups or Parent Training and Information Centers (PTIs) for free or low-cost support.
✅ Explore Therapy & Outside Evaluations
- If your child’s emotional control issues are worsening, outside therapy, behavioral support, or medical evaluations may be needed.
- Private evaluations can provide recommendations for IEP services.
✅ Consider Changes in Placement or Schedule
- If the current setting isn’t working, explore adjusted schedules, support staff, or smaller class environments.
⚖️ If You Disagree with the Outcome
🚨 If the school rules against your child in the MDR and suspensions continue:
- You can request mediation, file a state complaint, or request a due process hearing.
- Document all communication and disciplinary actions.
- Keep records of how the school is implementing (or failing to implement) the IEP.
💡 Tip: Your child’s IEP should be a proactive tool—not just a reactive one. If suspensions keep happening, the current supports aren’t working. Push for meaningful changes to prevent future disruptions! 🚀
